Terms of Sale
Last updated: 01/01/2025
These Terms of Sale ("Terms") govern all catering orders placed with Altitude Dining ("we", "us", "our"). By placing an order or submitting a request through our website, you ("the Client") accept these Terms.
1. Our service
Altitude Dining provides gourmet catering for business and private aviation, including private jet flights, government flights, and event catering. Orders are placed on behalf of crew, operators, or agents — not by end passengers directly.
2. Orders
An order or request submitted through our website is an invitation to supply and does not form a contract until we confirm it in writing (by email). We may decline or adjust any order subject to availability, location, lead time, or product sourcing.
To process an order we require, at minimum: the aircraft tail number, the delivery method, a valid phone number, and the requested delivery date and time.
3. Prices
All prices shown are estimates, displayed in the currency of the destination airport. Final pricing is confirmed at order acceptance and may vary with final quantities, sourcing, and local delivery conditions.
Where a price is charged in advance and the confirmed total is lower, we refund the difference. Taxes, duties, FBO handling fees, and third-party charges may apply and are the Client's responsibility unless stated otherwise.
4. Payment
Payment terms are confirmed at order acceptance. We reserve the right to require advance payment, particularly for first-time clients or short-lead orders.
5. Delivery
We deliver via the method selected at order: FBO, van delivery, pick-up, or high loader. Delivery times are targets, not guarantees: aircraft schedules, slot changes, customs, security, and airport or FBO access are outside our control. The Client is responsible for providing accurate delivery details and ensuring access is available at the agreed time.
6. Changes and cancellations
Change and cancellation requests must be sent to support@altitudedining.com as early as possible. Because catering is prepared fresh to order, charges may apply to changes or cancellations made after preparation has begun. Specific terms are confirmed at order acceptance.
7. Food preparation and allergens
Catering is prepared by independent partner kitchens. Those kitchens are solely responsible for food preparation, hygiene, and allergen handling. The Client must declare any allergies or dietary requirements when ordering so they can be passed to the kitchen. Altitude Dining coordinates orders and does not prepare food.
8. Liability
To the fullest extent permitted by law, our total liability for any order is limited to the amount paid for that order. We are not liable for indirect or consequential losses, or for losses caused by inaccurate information provided by the Client or by third parties (airports, FBOs, handlers, couriers).
9. Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including weather, flight delays or cancellations, airport or airspace closures, strikes, or supply disruptions.
10. Privacy
We process personal data in accordance with our Privacy Policy.
11. Governing law and disputes
These Terms are governed by the laws of [JURISDICTION TO BE CONFIRMED]. Before pursuing any formal action, the Client agrees to contact us first so we can try to resolve the matter directly.
